These Terms of Use ("Terms") are an agreement between you and Carter Ebare, the developer of PulsePoint Sports ("we," "us"). They govern your use of the PulsePoint Sports mobile app and related websites (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Who can use the Service
You must be at least 13 years old to create an account. If you are under 18, you may use the Service only with the involvement and permission of a parent or legal guardian, who agrees to these Terms on your behalf.
2. Your account
Provide accurate information and keep your sign-in details secure. You are responsible for activity under your account. Tell us at support@pulsepointsports.com if you believe your account has been used without your permission. You can delete your account at any time in the app from the Account tab.
3. Tournament information
Tournament listings, divisions, schedules, scores, standings, and announcements come from tournament organizers, from staff who enter them on an organizer's behalf, and from publicly available sources, including third-party tournament listing websites. Where an organizer publishes official results elsewhere, the app links to them. Tournaments marked "Demo" are sample listings we provide so you can try the app; their teams, games, and scores are fictional. We are not the organizer of any tournament and are not affiliated with or endorsed by an organizer unless we say so. Information can be incomplete, delayed, or changed by the organizer at any time, and scores shown in the app are not official results. Always confirm game times, locations, and rules with the tournament organizer. We are not responsible for decisions you make based on information in the Service.
4. Partner offers and outside links
The Service shows offers from local businesses and other partners near your tournament. Some of these are paid placements or affiliate links, which means we may earn a fee or commission when an offer is shown, tapped, or used. This does not change the price you pay. Tours and activities marked "Book on Viator" are provided by Viator, a Tripadvisor company, and its suppliers; bookings, payment, changes, and cancellations are handled by Viator under its terms, and we may earn a commission on them. Offers and outside websites are provided by third parties, not by us. Your purchases and reservations are between you and that business, under its terms and policies, and we are not responsible for its products, services, prices, or availability.
5. Acceptable use
You agree not to:
- use the Service for anything unlawful, harmful, or harassing;
- try to access accounts, data, or systems you are not authorized to access, or interfere with the Service's security or normal operation;
- collect data from the Service by automated means (scraping, bots) or overload it with requests;
- impersonate anyone, or misrepresent your relationship with a team, organizer, or business;
- copy, modify, or reverse engineer the app except where the law allows it.
6. Organizer and staff accounts
Some accounts are given staff access to post tournament announcements and manage listings. Staff users must have authority from the relevant organizer, must post accurate and appropriate content, and are responsible for what they post. Staff may upload only images they own or have permission to use, and must not upload images that identify a minor without a parent's or guardian's permission. We may remove content or staff access at any time.
7. Ownership
The Service, including its design, software, and the PulsePoint Sports name and logo, belongs to us and is protected by law. Team, organizer, and business names and logos belong to their owners and are shown only to identify them. Some place information is © OpenStreetMap contributors, available under the Open Database License, and some may come from Google. We give you a personal, non-transferable, revocable license to use the app for its intended purpose, subject to these Terms.
8. Ending your use
You may stop using the Service and delete your account at any time. We may suspend or close accounts that violate these Terms or put the Service or other users at risk, and we may change or discontinue features. Sections 3, 4, 7, 9, 10, and 12 continue to apply after your account ends.
9. Disclaimer
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement, and we do not promise that the Service will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or opportunities, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed fifty U.S. dollars (US$50). Some jurisdictions do not allow these limitations, so they may not fully apply to you.
11. Apple App Store
If you downloaded the app from Apple's App Store:
- These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the app and its content.
- Your license to use the app is limited to Apple-branded devices you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection or privacy claims, and claims that the app infringes a third party's intellectual property rights.
- You confirm you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. Changes to these Terms
We may update these Terms. We will change the effective date above and, for material changes, notify you before they take effect, for example in the app or by email. Continuing to use the Service after changes take effect means you accept them.
